Demolition and Renovation - State of Colorado Requirements

State of Colorado - Demolition/Renovation Permit and Information.

The San Luis Valley Regional Solid Waste Authority accepts demolition, friable and non-friable asbestos waste, fire debris, and contaminated soil from the six area regional partners it is designed to serve and support: Alamosa, Conejos, Costilla, Mineral, Rio Grande, and Saguache counties. Hauling of solid wastes from other counties is discouraged and requires the approval of the Landfill Manager. If you have questions, contact the landfill office at (719) 852-3810.

Before you start a remodel, renovation, or demolition, a State of Colorado Demolition Permit is required. Additionally, Asbestos testing results and the Generator Waste Profile Packet need to be submitted to the Landfill Manager along with the State of Colorado Demolition Permit. If testing results are positive for Asbestos, the Inspection and Remediation results are required.

How Do I Turn Off My Waste Management Services When Someone Dies?

If any utilities were in the deceased's name, such as waste, electricity, gas, water, phone, cable, and internet, these utilities should either be canceled or transferred to the name of a survivor. Cancelation or transfer can be achieved by calling our customer service number at (719) 655-2833. It is illegal to keep any utilities in a deceased person's name if you do so intentionally to deceive the utility company. Closing the deceased's accounts and transferring utilities are the responsibilities of the estate's executor or a family member. Conley Waste Management's policy is that all waste service connections must be transferred within 30 business days of death.

Fees & Policies

Please note that as of March 2016, Conley Waste Management will charge a $25 fee for each incident when an automatic draft or check is denied or returned for insufficient funds. This fee is in addition to any fees your financial institution may charge you. Your monthly payment is due on the 15th of the month of service.

Please note that effective May 1st, 2017, Conley Waste Management will only generate an invoice when a balance is due. Customers paying in advance will only see an invoice once all the credit has been applied.

Any past due balance is subject to a 7-10% monthly service charge. Additional fees may apply for delinquent accounts submitted to collections for processing.

Service reactivation due to non-payment is subject to a reactivation fee.

Fees:

Standard Charges: Quote Required. Contact our main office using the Service Order button on our main web page, or call 719-655-2833. Pricing is based on rental length, container size, drop location, Rio Grande County and/or Saguache County Landfill rates, and current fuel pricing.

  • Overloaded containers above line: $200.00 (see overloading debris)
  • Unable to Pick Up/Drop off: $135.00 (Overloading and Dry run recovery fees)
  • 2-ton weight limit: Additional tons $150 per each ton (terms and conditions)

Short term rental: 10 Day Time Limit. (see extend short term rentals below)

Long term rental: Long term rentals require a Dump & Return (swap) service every 30 days. Special situations may be considered with an a $175 per month rental fee assessed for containers not emptied on a standard monthly basis.

Roll-off Container Damage Fee: Damage fees are assessed on a case-by-case basis depending on damage to steel, replacement costs, and welding repair fees. Total loss fees are up to $8,500 per container.
Terms and Conditions:
Customer is fully responsible for any and all associated/assessed charges including fees assessed by State, County, City, or Federal agency of all cost, fines, penalties, or other actions taken for said disposal of container contents within Saguache or Rio Grande County. Costs may include, but are not limited to, cleanup, monitoring, legal fees, penalties, or any other charges associated with unauthorized material disposal.Customer is responsible for a $200.00 fee if there are items over the labeled fill line on the top of the container.Customer is responsible for any tipping fees over 2.0 tons at the rate of $150.00 per ton. Payment for all fees will be billed monthly in accordance with Conley Waste Management billing schedule.

Prohibited Materials and other restrictions

  • While the container is in your possession, customer agrees NOT to place or allow to be placed into the dumpster; substances hazardous to health such as toxic or corrosive materials, liquids of any kind, medical waste, animal carcasses, yard waste such as dirt, rock, or concrete, propane tanks, electronics, appliances containing freon, pressure treated lumber, and tires.
  • Large amounts of steel require a separate container for steel products only.
  • Customer agrees not to fill any roll-off higher than the labeled line. If there are materials past the line there will be an additional fee.
  • Customer agrees not to light fires in the container.
  • Customer is responsible for any damages to the container other than normal wear and tear while in the customer's possession. This includes but is not limited to fire, theft, vandalism, negligence, graffiti, natural disaster, or any other activity which may cause damages.

Overloading Debris 

Containers must not exceed the their volume capacity. If a dumpster has anything sticking above the height of the wall, it must be rearranged in order to legally be hauled. Laborers often overfill dumpsters. It is your responsibility to ensure the debris is below the wall height.

Conley Waste drivers are NOT permitted to rearrange debris for you. If debris is over the top, our insurance requires that driver NOT pick up the dumpster to comply with DOT safety regulations.

Containers shall be loaded evenly and placed on hard level surface to insure safe transportation of contents.

**If we are not able to remove the dumpster, a $135 additional trip fee will be charged (plus applicable distance fees). You will need to rearrange the debris so that we can schedule another removal attempt.**

Dry Run Recovery Fee

If a container cannot be picked up or dropped off for the following reasons, a $135 trip fee may be assessed to the client (plus applicable distance fees):

  • Overweight Container
  • Debris filled above container wall height
  • Vehicles or any other items blocking access to pick up or drop off a container
  • Inaccessible driveways or parking lots due to locked gates or any other reason
  • Low power lines or tree branches
  • Relocation Fee

Note: Containers must not be moved by the client. We can relocate the container upon request and apply a $135 trip fee (plus applicable distance fees).

Extend Short Term Rentals

After 10 days (or the written term of the rental), clients will incur a daily charge of $20 Per Day for each container rental on the job site.

To dump and return a container costs the same as the initial rental fee, and resets the rental day clock to 10 days for regular term.

Long term rentals require a Dump & Return (swap) service every 30 days, or may incur additional fees

Property Damage

Conley Waste Management is not responsible for property damage, including but not limited to ruts, driveway damage, landscape damage or any other damage. Customer should take steps to protect surfaces (e.g. driveway, paving slabs, and soft ground) before delivery.

Mediation

If there is a breach of this agreement by either party, the breaching party will pay all reasonable attorney fees, collection fees and costs of the other party. The client agrees to submit any dispute arising under this Agreement first to mediation, then if not resolved, to Arbitration.

If any portion of this agreement is deemed unenforceable, all other provisions of this Note shall remain in full force and effect. The Terms and Conditions Agreement shall be interpreted under the laws of the State of Colorado. Customer agrees to indemnify and hold harmless Conley Waste Management of any and all damage which may occur to the property where the container is located. All reasonable care will be taken during placement and removal of the container to protect the property. Conley Waste Management will not be responsible for damage to road surfaces, sod, lawn, asphalt, landscaping, overhead obstructions, etc. Customer acknowledges that during the container rental they will retain, care for, and control container contents. Customer will indemnify and hold harmless Conley Waste Management, its owners, employees, agents, and corporate associates of any damage or injury to persons or property while the container is in the customer’s possession and until the contents are disposed of. Customer is fully responsible for the entire contents of the container and is the rightful owner of the contents until the contents are disposed of and accepted without protest by the prospective disposal facility.

What are the chances I’ll have additional charges?

If you follow the rules, you should not have any additional charges. Most of our clients never have additional charges and have rented from us repeatedly for years.

However, we do have some outliers where the rules were not followed, and Conley Waste incurred additional costs on your behalf. If we incur additional costs on your behalf, we simply pass on to the Client to recover un-included costs.

"All users, release Conley Waste Management from all responsibility for damages that may occur during the placement or retrieval of the container, damages caused by the weight of the truck or the weight of the container.

All clients agree unconditionally to pay for all services rendered, including reasonable attorney’s fees incurred in the collection of monies owed. All clients understands that payment is due prior delivery of the container. The client agrees that any balances due may be charged to authorized credit cards on file. Balances are subject to a 7% late charge on any outstanding balance, if not received according to terms."
